I noticed that one of the hotfixes I tried to install post R3 SP2 fails even manually, so I wonder if that could be what LU is trying to do? Here is the verbage of the LU:

Then I try live update again, and it looks like it's trying to download and install the R3 install, which is already on and has been for some time.

I thought it was having issues with a certain sp or hotfix, so I manually applied SP2 to our 2010 R3 install, and installed 4 hotfixes post SP2.

Ever since I updated to BE 2010 the live update tries to update and fails.
